Violating Traffic Law shall be fined up to 30 million VND, vehicles to be confiscated |
|
The newly issued Decree No. 146/2007/NĐ-CP provides regulations of fine rates and very strict administrative fining ways toward violated activities to the Traffic Law. Exchanged with the Senior Lieutenant Colonel Đỗ Vũ Anh Dũng – Vice Director of the Road & Railway Traffic Police Bureau (Ministry of Public Security).
Highest level: 30 million VND per one violation time
Senior Lieutenant Colonel Đỗ Vũ Anh Dũng said that : according to the new regulations in the Decree 146, the highest level of fine is from 20 - 30 million VND to behaviors like: motorbike, car, motorized vehicle, electric motorbike racers those who prevent duty officers from doing their duties; organizing illegal racing.
Additionally, some violation activities and regulations have been amended: operating vehicles under the minimum speed on road sections where the allowable minimum speed is specified, the fine shall be from 600,000 VND to 1,000,000 VND; controlling motorbike under the minimum speed on road sections where the allowable minimum speed is specified, the fine shall be from 200,000 VND to 300,000 VND.
For cases of driving vehicle using drugs alone, the fine shall be from 3,000,000 VND to 5,000,000 VND, expropriating driving license for timeless period and keeping temporarily vehicles for 10 days. Driving motorbike using drugs, the fine shall be from 1,000,000 VND to 2,000,000 VND, expropriating driving license for timeless period and keeping temporarily vehicles for 10 days.
Vehicle owner undertakes fraudulence to get registered board, register paper to be re-granted; giving vehicle or letting under conditioned people as specified by the law to control vehicle taking part traffic, the fine shall be from 200,000 VND to 300,000 VND.
Motorbike owner undertakes fraudulence to get registered board, register paper to be re-granted; giving vehicle or letting under conditioned people as specified by the law to control vehicle taking part traffic, the fine shall be from 100,000 VND to 200,000 VND.
The Decree 146 also increases fine rate towards conscious behaviors of road users in following road traffic rules, such as: stopping. Parking, getting aside, overcoming, going direction, lane, traffic sign, speed.....
Besides, there is regulation added that allow violated people to pay fines by deducting from their bank accounts.
Expropriating driving license, confiscating vehicles
According to Senior Lieutenant Colonel Đỗ Vũ Anh Dũng, there are many new points in the Decree 146/2007/NĐ-CP compared with the previous Decree 152/2005/NĐ-CP such as: to replace marking number of violations on driving license by expropriating right to use driving license for termed period and force to learn and test again knowledge of the Road Traffic Law before returning driving license to cases that driving license was expropriated for 60 days and 90 days.
The following is the detailed discussion of Mr.Dũng upon these new points.
- Could you let us know that in which case, driving license shall be expropriated and in which case, vehicle shall be confiscated?
Timeless Expropriation of driving license shall be made to cases using drugs while controlling vehicles; driving vehicles without proper attention and observation, running vehicle faster than specified speed causing accidents, then driving license shall be expropriated for 9-0 days if that accident is under serious level. Timeless Expropriation shall b made if causing accident from serious and higher level. Expropriating driving license for 60 days shall also be made when controlling vehicle exceeding the specified speed at 35km/h.
For cases where vehicles to be confiscated including: using vehicle over the specified using time of the Government; using self-made, self-assembled vehicles; improving normal vehicles to passenger vehicle; illegal racing; driving motorbike, non-motorized vehicle that re-violate zigzag , one wheel running.
- In case the driving license is expropriated, what regulations does violator have to follow?
During driving licence expropriation time, certificate of training legal knowledge on road traffic, violator are not allowed to operate vehicle. For cases that driving license expropriation time is 60 or 90 days, they are to learn and test again legal knowledge on road traffic before receiving back their driving license.
- Since the fine level is very heavy, do you think that violators will surely have reactions?
Fine levels have been increased toward some violated behaviors plus with additional punishment, handling methods is stronger so it may be possible that some violators shall have certain reaction, thus the mass media is required to further strengthen public communication. Organizations and agencies need to do good education on self obedience of the traffic law to their members and then functional forces have to implement strictly violations.
In addition, the workload shall increase, especially functional agencies in chares of handling violation in road traffic order. Violators whose driving license is expropriated for 60 or 90 days as specified are forced to learn and test again their knowledge in road traffic; and their violations shall also be notified to their office, school, people’s committee of commune, living places where violators live and work for education and review Trang mua ban rao vat so 1 VN
